TM1 version without maintenance

Hello,
I have a customer using TM1 version 8.4 and cancelled the maintenance at end of last year 31th of December 2009.
They would like to upgrade and know which version can be used at their site from legal point of view.
9.4.1 FP2 (released before cancellation)
9.4.1 FP3 HF9 (released after cancellation)
9.5.0 HF1 (released before cancellation)
9.5.0 HF2 (released after cancellation)
9.5.1 latest HF(released after cancellation)

Why aren't they asking IBM this question? They are the only ones that are going to have an answer.

It depends on the precise wording of the maintenance contract.
However, under the maintenance contract we use, which I think is pretty standard, customers are entitled to new versions and releases only when they are covered by the support contract. If the contract is not renewed they are no longer covered; they cannot retrospectively ask for releases becuase they had been available when they were supported.
If customers intened to cancel their support contract it probably makes sense for them to get the latest version before they do so!

Yes, my understanding is the same. And I've been told that getting back onto maintenance if it's dropped is an even bigger bureaucratic nightmare than the process of paying it.
(Oh for the simple days of Applix... they send an invoice (without trying to sneak through well-over-the-odds increases), you pay the invoice (without having to yell at them for trying to sneak through well-over-the-odds increases and getting another replacement quote.))
But they should indeed contact IBM for confirmation. Big Blue might be feeling in a magnanimous mood, and offer the current version as an incentive to resume maintenance at a future time, dangling the prospect of 9.5.2 as further bait.
